Judge Rules Against Point Beach Parking Ordinance

Point Pleasant Beach officials say they’ll be seeking a stay on a judge’s decision that strikes down their summertime overnight parking ordinance in the tourism district. Citing conflict of interest, Ocean County Superior Court Judge Vincent Grasso ruled that one of the voting council members should have abstained because he stood to benefit financially from the ordinance, according to

Grasso said in a written opinion that Councilman Michael Corbally, a Realtor, has a conflict because he owns a business in the affected 4 district.

Hoping to keep the ordinance in place during an appeal of the decision, Point Pleasant Beach Mayor Vincent Barella says the governing body gave the borough attorney authorization to file the stay.

The suit was filed by charter boat fishing businesses who said the parking ordinance posed a hardship to their businesses because their customers couldn’t park during overnight excursions. Report say a similar motion was also filed by Point Pleasant Bar and Restaurant venue Martell’s.

Borough officials initially enacted a pilot overnight parking ban during the summer season last year in an effort to prevent overnight revelers from disturbing residents on local streets. The reintroduced the ordinance this year.
